Broadly speaking, there are 3 main types of promotion:

1. Prize draws and select winners by chance

These can be linked to purchase. 

Residents of Northern Ireland can be required to purchase as well.  If you’re going to require purchase though, you should ask for proof otherwise you risk misleading potential entrants which is not a good thing.

2. Skill-based winner selection

Where an entrant has to submit a photo or a piece of text and the entries are judged. These can also be linked to purchase. The criteria on which the entries will be judged need to be clearly set out in the terms and conditions so there’s a bit more work required before the promotion starts than with a prize draw. It’s important to factor in the requirements for an independent judge, for that person’s name to be made publicly available, and for the time to judge down the entries.

3. Instant win promotions.

There are three main types of instant wins:

    1. Winning Moments. These are where a series of times are set and the entrant at or immediately first after, wins the prize.These tend to result in all prizes being won.
    2. Winning Codes. A series of codes are produced and specific codes are marked as winning codes.  When the code is submitted, the entrant is advised they have won.  These have become less popular over the years as due to low uptake rates large amounts of winning codes are not entered.  These are best tied with a prize draw at the end to guarantee a set amount of winners.
    3. Algorithms based on volume of packs produced. These are very unpopular with the ASA right now and promotions are being sanctioned for not explaining very clearly that the likelihood is that only a small percentage of prizes will be won.

Zoë’s main promotional compliance services include assisting on determining the most appropriate promotional mechanic, drafting terms and conditions, selecting winners of promotions and providing unique codes for promotions requiring purchase.  She reviews user journeys and checks communications and artwork. 

She also assists clients with the documentation required to be in place before running a promotion including preparing or reviewing privacy policies, terms of use of website, opt-in statements and data processing agreements. 

ZXL Consulting works with all departments as required.  We work with marketing teams for the general scope of the promotion and the terms and conditions, we review on-pack artwork and webpages with design teams, we work with tech departments for user journey issues and with legal teams for privacy issues.
